On September 16, 2025, Jungyong Park, Managing Attorney of LAWAMERICA’s Seoul office, gave a presentation on dispatching expatriate employees to the United States at the “Overseas Expatriate HR Management and Development” seminar hosted by the Korea Personnel Improvement Association.

At the seminar, held at the Samjung Education Center near Seoul Station, Attorney Park explained to HR professionals from Korean companies the types of U.S. visas available for employees dispatched to the United States, visa eligibility requirements, and potential corporate law and litigation risks that U.S. subsidiaries may face.
In particular, participants raised many questions about the types of visas required when dispatching employees to the United States in light of the recent arrest and detention of approximately 300 Korean workers during the construction of an electric vehicle battery plant in Georgia. The workers were alleged not to have had appropriate visa status authorizing their activities in the United States. In response, Attorney Jungyong Park explained the types of visas that may be used for short-term assignments of employees to the United States and important considerations during their stay.
Through written materials, Jieun Park, Managing Attorney of LAWAMERICA’s Irvine office, noted that Korean companies entering the U.S. market frequently encounter litigation not only over contractual disputes but also in connection with the operation and personnel management of their U.S. entities, including employee hiring and termination. Attorney Jieun Park emphasized that, to prevent such disputes and respond effectively when they arise, companies should carefully review contracts from the outset for provisions that could adversely affect their U.S. entities and have their contracts reviewed by U.S. counsel.
