A U.S. citizen parent applied for a Consular Report of Birth Abroad (CRBA) and a U.S. passport for a child born in Korea, and both applications were approved.
1. Case Overview
Type: Application for a Consular Report of Birth Abroad for a child born abroad to a U.S. citizen parent
Applicant: U.S. citizen parent of the child
Result: Issuance of a Consular Report of Birth Abroad and a U.S. passport
2. Case Background
When a child of a U.S. citizen is born outside the United States, the child may acquire U.S. citizenship through a Consular Report of Birth Abroad if certain requirements are met.
To apply for a Consular Report of Birth Abroad, the following requirements must be met:
The application must be made before the child reaches 18 years of age.
At least one parent must be a U.S. citizen.
If both parents are U.S. citizens, at least one parent must have actually resided in the United States.
If only one parent is a U.S. citizen, the U.S. citizen parent must have been physically present in the United States for at least five years before the child’s birth, including at least two years after reaching the age of 14.
In this case, only one of the child’s parents was a U.S. citizen. We therefore prepared documentation demonstrating that the U.S. citizen parent had been physically present in the United States for more than five years. The parents and the child attended an interview with a consular officer at the U.S. Embassy in Seoul, and the applications for the Consular Report of Birth Abroad and the U.S. passport were approved.
